Draft for a lawyer
Terms
Clark’s Out of Town Landlord, myoutoftownlandlord.com. This page is a draft. It is not in effect, and no funds should be collected until a lawyer has reviewed it.
What Clark’s does
Clark’s Out of Town Landlord introduces an owner who lives away to a KeyKeeper in that community, and to local handymen. Clark’s is not a property manager, not a law firm, and not a consumer reporting agency. Clark’s does not hold the rent, sign a management contract, or file an eviction.
Who may open an account
A landlord account is for the owner of record. An estate account is for a person who can show the court document and the court site. A handyman lists only after Clark’s checks the photo ID, the name on that ID, the street address, phone, and email. A business account is for a company buying an advertisement. A tenant uses a landlord number given by that landlord.
Membership
The first 7 days are free. After that, a card on file is required. The planned rates are $22.99 a month, $74.99 every 3 months, $89.99 every 6 months, $149.99 a year, or $124.99 if the year is paid up front. Handymen do not pay to list. These rates are not being charged until payments are connected and a lawyer has reviewed this draft.
KeyKeeper visits
The owner and the KeyKeeper agree the fee for a porch check, a storm walk-through, a lockbox, or meeting a contractor. Clark’s does not set that fee and does not take a percentage of it. A KeyKeeper may not be enrolled in every state.
Handyman work
The owner and the handyman agree the price. Clark’s does not set it. If no KeyKeeper is enrolled in that state, the planned finder’s fee is $49, paid to Clark’s, separate from the handyman’s price. The plan is that both amounts are sent to Clark’s, and Clark’s pays the handyman only after proof of work. A lawyer must review that plan before any money is held.
The tenant packet
The applicant pays the $35 packet fee. The packet is the ID they upload and the answers they type, including whether they say an eviction was filed in the last five years. Clark’s does not run a credit report, an eviction search, or a background check. The landlord who shared the number receives the packet.
Advertising
A larger company may pay for a neighborhood, county, or statewide placement. An advertisement is not a recommendation from Clark’s and is not a verified handyman listing.
Accounts
One sign-in opens one account. The person who enrolls is responsible for what they upload and for having the right to act for that property or shop. Clark’s may refuse or close an account that cannot be verified.
